Terms and Conditions
These Terms and Conditions (the “Terms”) govern applications for World Wide Fund for Nature New Zealand's ("WWF-New Zealand", “us”, “our”, “we”) Conservation Innovation Awards 2016 (the “Awards”) being operated on the website https://wwf-nz.crowdicity.com/ herein after referred to as “the Platform”, and the relationship between us and you as an applicant and a user of the Platform. By submitting an application in any form to us you agree to these Terms.
2. Specifications for registering to use the Platform
2.1. A User account shall be personal and is not transferrable. The Users undertake to keep all information confidential which relates to the use of their User account (in particular passwords) and shall store such information with due care.
3.1. We may involve third party subcontractors when providing our services in relation to the Platform.
3.2. We shall not be liable for third party content and information accessible on the Platform nor for any loss or damage whatsoever (including indirect and consequential damages) which may arise in connection with the use of the Platform and you indemnify us for any loss, damage, cost or expense suffered or incurred by us in relation to your use of the Platform.
3.3. WWF-New Zealand shall not be liable for any possible partial or full deficiencies of the Platform. You hereby acknowledge that a fully error free availability of the Platform is not be guaranteed and WWF-New Zealand can therefore not be held responsible.
3.4. To the extent that we reasonably can and it is within our reasonable control, WWF-New Zealand undertakes to be in observance of all applicable laws and regulation, in particular, pertaining to telecommunication and data protection.
3.6. WWF-New Zealand is entitled to remove and delete User accounts or User profiles with a notice period of a fortnight (14 days) without cause.
3.7. WWF-New Zealand is entitled to remove and delete User accounts or User profiles in case that the User in question has not developed any activities on his or her User account or his or her User profile for a period exceeding six (6) months; however, WWF-New Zealand will inform the User in question twice prior to such possible removal or deletion.
4. Intellectual Property Rights
4.1. For the purposes of this clause 4, "Intellectual Property Rights" means copyright, and all rights conferred under statute, common law or equity in relation to inventions (including patents), trade marks, designs, circuit layouts, domain names, rights in databases, confidential information, trade secrets, know-how, and all other proprietary rights, whether registered or unregistered, and all equivalent rights and forms of protection anywhere in the world, together with all right, interest or licence in or to any of the foregoing.
4.2. If you submit an application as an employee or member of an organisation which you represent for the purposes of the Awards:

4.4. WWF-New Zealand and its licensors shall hold and retain full title to all Intellectual Property Rights pertaining to the Platform.
4.5. For all content and information you make accessible on the Platform at any time you grant a non-exclusive, worldwide, perpetual and royalty free license to WWF-New Zealand and all other Users to use, copy, modify and distribute such content and information in any way and for any purpose whatsoever, provided that the author (or authors) are acknowledged. In particular, in relation to WWF-New Zealand, it may publish and implement such content and information for a specific project chosen by it.
4.6. You indemnify WWF - New Zealand against all liabilities, damages, expenses and losses (including all legal costs) arising from any allegation or claim that our use of any information, rights or materials supplied to us by you under these Terms, infringes any third party's Intellectual Property Rights.
5.1. Subject to clauses 5.3 and 7.3 each application must:

5.2. Applicants must have or be able to obtain any consents or approvals that are necessary to implement their idea.
5.3. We reserve the right to disqualify applications that WWF-New Zealand determines, in its sole discretion, do not meet the above requirements.
6.1. Any contribution to the Platform may be moderated by a WWF-New Zealand staff member or its personnel before or after the contribution appears on the Platform.
6.2. Moderation may involve editing, modifying or removing all or part of a contribution with or without consultation with the User at WWF-New Zealand's sole discretion.
7. Assessment Process
7.1. We will appoint a judging panel to review all Qualifying Applications after the closing date, and to decide the winners (the "Judging Panel"). Applications will be assessed against the information provided on the “SHARE YOUR IDEAS” page, and on your achievement of any required milestones indicated on the Platform.
7.2. Information about each of the judges will be published on our website.
7.3. We may, at our sole discretion, disqualify your application and/or revoke any Award grant at any time if:
7.4. The decisions of the Judging Panel will be final and discussion will not be entered into.
8. Prize package
8.1. The total prize pool is NZ$75,000 (inclusive of GST) comprising three prizes. Each prize is a of grant of up to NZ$25,000 (inclusive of GST). The prizes will be awarded to the three most outstanding applications as determined by the Judging Panel in its sole discretion. If three outstanding winners cannot be determined, the Judging Panel may split the total NZ$75,000 prize pool between more or less than three applicants.
8.2. The prize winners must each agree terms, including performance and reporting milestones, with WWF-New Zealand before any grants will be paid (such agreement not to be unreasonably withheld).
8.3. You acknowledge that WWF-New Zealand may promote winners in news media and through WWF-New Zealand communication channels, prior to, on the Awards night, and during the term of the agreement referred to in clause 8.2.
8.4. Winners are each eligible for NZ$400 worth of return airfares and one night's accommodation for one representative to attend the Awards event in Wellington.
9.1. If you win an Award, you consent to us using your name and the name of the entity or organisation that you represent (if applicable) and description of your idea (including photographs/footage of any resulting products/outputs) without further compensation, for the duration of the grant period (which will be set out in the funding agreement that we intend to enter into with each Award winner), in New Zealand and overseas media and through WWF-New Zealand communications channels.
10.1. WWF-New Zealand is required to comply with the Privacy Act 1993. Any personal information about individuals provided as part of an application will only be used by WWF-New Zealand to assist with the administration and assessment of that application and in publishing the results of the Awards (including the first place winners and the promotion of future Awards).
10.2. Subject to clause 9.1, any personal information or other information collected by WWF–New Zealand as part of an application will be exclusively for the use of WWF-New Zealand's Board of Trustees and staff, the Trustees and staff of the Tindall Foundation and any other parties contracted by WWF-New Zealand to act on behalf of WWF-New Zealand, for the purposes of determining, promoting and administering the Awards.
10.3. Individuals have the right to request, access, check and correct any personal information held by WWF-New Zealand.
11. Changing or Cancelling the Awards
11.1. We reserve the right to make changes to or cancel the Awards at any time, including by changing dates or the Award amounts.
11.2. If we do so, we will notify you of the change or cancellation via our website. If we make changes to or cancel the Awards, we accept no responsibility for any losses or damage you incur as a result of our decision to do so.
12. Applicable Law and Jurisdiction
The Terms (excluding any terms and conditions of Crowdicity in relation to the Platform) are governed by New Zealand Law and the parties irrevocably submit to the exclusive jurisdiction of the New Zealand courts in any proceedings relating to it.
